1. Introduction
As of May 1, 2024, Fastwork and its related parties have updated the Terms and Conditions to better align with our business activities and services. These Terms are specifically designed for our platform and will be periodically revised to reflect any changes.
Fastwork is an online service provider platform accessible through our apps and website (https://www.fastwork.in). We offer a range of services including Electrician Services, Photographer Services, Makeup Artist Services, Air Conditioner Repair Services, and more. Each department is staffed with experienced and skilled professionals. Service providers have profiles listing their service packages, which customers can order, and Fastwork ensures these orders are fulfilled.
Our operations currently serve Bajkul, West Bengal, India, and we plan to expand to other states in the future. This platform is intended for personal and non-commercial use within India only. Our terms and conditions apply exclusively within India and are not valid in any other country.
2. Services
Fastwork offers a variety of services categorized under different departments. Each category includes multiple service providers who upload, edit, and manage their service packages on their profiles. Customers can view and order these packages at varying prices based on service quality, time, expertise, and experience.
Service providers must create an account on Fastwork (with email, mobile number, and password) to upload their profiles and service packages. These packages are reviewed and approved by the Fastwork team before being published. Any illegal content will result in the deletion of the profile and service package by Fastwork authorities.
Each service package comes with a 5-10-day servicing warranty. If a service issue arises within this warranty period, a free service will be provided. However, the cost of any parts required will be charged separately.
3. Account Creation
(a) To access our services, you must create an account on the platform (“Account”), providing necessary details including, but not limited to, your phone number. You must be at least 18 years old to create an account.
(b) You warrant that all information associated with your account will be accurate and truthful. You agree to promptly update your details on the platform in case of any changes or modifications.
(c) You are solely responsible for maintaining the security and confidentiality of your account and agree to notify us immediately of any unauthorized use of your account or any other breach of security.
(d) You are responsible for all activities that occur through your account, including those performed by others. We are not liable for any unauthorized access to your account.
4. Booking
(a) Order: The platform allows you to request various services at your preferred time based on available slots. Follow the instructions on the platform to provide the required information for booking. If we cannot find a service professional for your requested time slot, we will contact you to arrange an alternative.
(b) Confirmation: Once you make a request, we will confirm the booking via SMS, email, or push notification. You must make payment according to these Terms or as directed on the platform. Confirmation of the identified service professional will be sent via the app, SMS, email, or push notification.
(c) Service Types:
Servicing Bookings: (Electrician, Air condition repair, DTH service) – Bookings can be made anytime, with service available within 1 to 3 days. The servicing date and time will be notified via SMS or email.
Non-Servicing Bookings: (Band team, makeup artist, photographer, DJ setup) – Typically advance bookings are made a week to a month in advance. The specified day and time will be reserved for the customer, with confirmation sent via SMS or email.
5. Booking Cancellation
(a) Servicing Bookings: Can be canceled up to 2 days in advance.
(b) Non-Servicing Bookings: Generally advance bookings. Cancellations must be made 8 to 10 days in advance; otherwise, the advance payment is non-refundable.
6. Service Charges
Fastwork offers various booking services:
(a) Servicing Bookings: (Electrician, Air condition repair, DTH service) – We charge a flat rate of INR 200 to 1200 for servicing. Additional parts charges are separate.
(b) Non-Servicing Bookings: (Band team, makeup artist, photographer, DJ setup) – We generally charge a 3% to 8% commission.
Emergency bookings may incur additional charges of INR 300-1000 and an extra 2%-4% commission.
7. Payment Methods
Fastwork offers multiple secure payment options:
Online Payments:
Credit Cards: Visa, MasterCard, American Express, and other major credit cards.
Debit Cards: Visa, MasterCard, RuPay, and other major debit cards.
Net Banking: Supported for all major Indian banks.
UPI: Google Pay, PhonePe, Paytm, BHIM, etc.
Digital Wallets: Paytm, Amazon Pay, Mobikwik, etc.
Cash on Delivery (COD): Available for select services, allowing customers to pay in cash upon service completion. COD availability is subject to service type and location.
Payment Terms:
Service Charges: Listed in the service provider’s profile, inclusive of all applicable taxes unless otherwise specified. Additional charges, if any, will be mentioned at the time of booking.
Payment Processing: Handled through secure gateways. A confirmation email or SMS will be sent upon successful payment.
Cancellations and Refunds: Governed by individual service provider policies. Refer to specific terms in the service provider’s profile. Contact Fastwork customer support for disputes.
Failed Transactions: Debited amounts will be refunded within 5-7 working days. Contact respective banks for issues.
Receipts and Invoices: Provided electronically upon service completion and successful payment.
Dispute Resolution: Report payment disputes within 7 days. Fastwork will coordinate with service providers and payment gateways for resolution.
Fastwork complies with all applicable Indian laws and regulations regarding payments, including the Payment and Settlement Systems Act, 2007, RBI guidelines on electronic payment systems, and GST regulations.

9. User Responsibilities and Conduct
(a) Users are required to use the platform responsibly and not engage in any activities that could harm Fastwork or other users. This includes, but is not limited to, uploading harmful content, attempting to hack the system, or using the platform for illegal purposes.
(b) Any misuse of the platform, such as creating multiple accounts to abuse the service or providing false information, will result in immediate termination of the account and potential legal action.
(c) Users must respect the service providers and their time. Any form of harassment, abuse, or inappropriate behavior towards service providers will not be tolerated and may lead to the termination of the user’s account.
10. Privacy and Data Protection
(a) Fastwork is committed to protecting user privacy and ensuring the security of personal data. We adhere to all relevant data protection laws and regulations.
(b) Users’ personal information, including contact details and payment information, will be stored securely and used only for the purposes of providing and improving our services.
(c) Users have the right to access, modify, or delete their personal data at any time. For any privacy-related concerns, users can contact Fastwork’s customer support team.
11. Dispute Resolution
(a) Any disputes arising out of or in connection with these Terms shall be resolved through good faith negotiations between the parties.
(b) If a dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration under the rules of the Indian Arbitration and Conciliation Act, 1996.
(c) The arbitration shall be conducted in English, and the place of arbitration shall be Kolkata, West Bengal, India.
12. Limitation of Liability
(a) Fastwork shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of the platform or the services provided.
(b) Fastwork’s total liability to a user for any claims arising out of or relating to these Terms shall not exceed the amount paid by the user for the services in question.
(c) Fastwork is not responsible for the actions or omissions of service providers, and users agree to hold Fastwork harmless from any claims arising from the service provider’s performance or failure to perform their duties.
13. Intellectual Property
(a) All content on the Fastwork platform, including text, graphics, logos, and software, is the property of Fastwork or its licensors and is protected by Indian and international copyright laws.
(b) Users are granted a limited, non-exclusive, non-transferable license to access and use the platform for personal, non-commercial purposes.
(c) Users may not reproduce, distribute, or create derivative works from any content on the platform without the express written consent of Fastwork.
14. Modifications to the Terms
(a) Fastwork reserves the right to modify these Terms at any time. Users will be notified of any significant changes through the platform or via email.
(b) Continued use of the platform after any modifications to the Terms constitutes acceptance of the new Terms.
15. Governing Law
(a) These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of India.
(b) Users agree to submit to the exclusive jurisdiction of the courts located in Kolkata, West Bengal, India, for the resolution of any disputes.

17. Termination
(a) Fastwork reserves the right to terminate or suspend a user’s account and access to the platform at any time, with or without cause, and with or without notice.
(b) Upon termination, the user must cease all use of the platform and delete any downloaded or printed materials from the platform.
18. Miscellaneous
(a) These Terms constitute the entire agreement between the user and Fastwork regarding the use of the platform and services.
(b) If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
(c) The failure of Fastwork to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
(d) Users may not assign or transfer any of their rights or obligations under these Terms without the prior written consent of Fastwork.
